Article 1 – Purpose and Scope

These Terms of Service (“Terms”) govern the access to and use of the platform operated under the name Soundpitch, a service of Beyond Beats BV (“Soundpitch”, “we”, “us”, “our”).

By registering an account, subscribing, purchasing credits, or otherwise using the platform and services, the user (“you”, “user”, “customer”) acknowledges having read, understood, and accepted these Terms, along with our Privacy Policy.

These Terms apply globally, regardless of the user’s domicile, and supersede any conflicting terms proposed by the user.

Article 2 – Services Provided

Soundpitch provides an online platform offering two main services:

  • Access to a curated label database, consisting of publicly sourced and verified contact information for music industry labels and professionals; and
  • Access to various tools and services designed to assist in the user’s creative, promotional, and professional endeavors.

Soundpitch makes reasonable efforts to maintain these services functional, up‑to‑date, and accurate. However, all services are provided “as is”, without any guarantee of uninterrupted availability, error‑free operation, or completeness of information.

Article 3 – Account and Eligibility

Access to the platform requires registration and the creation of an account.

Users must be at least 18 years old or have legal capacity to enter into binding agreements on behalf of a legal entity.

The user is responsible for maintaining accurate, current account information and for safeguarding their login credentials. Any activity performed under a user’s account is deemed to have been performed by that user.

Article 4 – Label Database Use

The label database consists of contact information that is exclusively sourced from publicly accessible records and verified at the time of inclusion. Soundpitch does not collect or distribute private, confidential, or proprietary contact information without consent.

Users must use the database responsibly and legally and refrain from engaging in spam, bulk mailing, scraping, harassment, or any form of unlawful communication.

While Soundpitch makes reasonable efforts to ensure that all information in the database was public at the time of collection, it cannot guarantee that such information remains current, accurate, or publicly accessible over time.

By using the database, you acknowledge and agree that:

  • all information provided is collected from public sources and/or with consent where required;
  • Soundpitch cannot be held liable for any claims, complaints, damages, or legal actions initiated by third parties (including labels or individuals) arising from the use, misuse, or perceived misuse of the database by the user;
  • you, as the user, are solely responsible for ensuring that your communications comply with applicable laws (including privacy and anti-spam laws).

Soundpitch expressly disclaims any liability for damages, disputes, or legal actions between the user and any third parties listed in the database.

Article 5 – Tools and Services

The platform offers a suite of tools and services to support users’ creative and professional needs. These may include content generators, analytics, search engines, or other utilities.

These tools and services are provided “as is”, without warranty of fitness for a particular purpose, legal compliance, or uninterrupted operation.

Users remain solely responsible for reviewing, verifying, and lawfully using any results or outputs generated.

Some tools and services require the use of credits as detailed in Article 6.

Article 6 – Credits

6.1 Nature of Credits

Some tools and services require the expenditure of credits to access or use certain features.

Upon starting a subscription, users receive a specified number of credits as part of their plan. Credits can only be used on the platform for eligible tools and services, have no cash or monetary value, and cannot be redeemed, refunded, or transferred, except with explicit written consent by Soundpitch.

6.2 Purchase of Additional Credits

If the allocated credits are exhausted, users may purchase additional credit packs at the rates indicated on the platform. Purchased credits are subject to the same restrictions and conditions as those initially provided.

6.3 Validity and Expiry of Credits

Credits granted or purchased are valid for the duration specified at the time of issuance (e.g., 12 months from allocation). Expired credits cannot be carried over or refunded.

6.4 Promotional or Free Credits

Soundpitch may, at its sole discretion, offer promotional or bonus credits. Such credits may carry specific terms, shorter validity, or usage limitations, as communicated at the time of issuance.

6.5 Credits upon Termination

Upon cancellation or termination of a subscription, any unused credits are forfeited and cannot be transferred, refunded, or reinstated, unless otherwise required by applicable law.

Article 7 – Subscription, Fees, and Payment

Soundpitch’s services are provided under a paid subscription model.

Subscription fees are payable in advance via the payment methods supported on the platform (e.g., Stripe, PayPal).

Unless cancelled at least seven (7) days before renewal, subscriptions renew automatically under the then‑current pricing.

Prices are exclusive of VAT unless expressly stated otherwise.

Failure to pay may result in suspension or termination of access, and Soundpitch reserves the right to charge late fees and legal interest in the event of overdue payments.

Soundpitch may adjust subscription fees periodically to account for inflation or other economic factors, with reasonable notice provided to users.

Article 8 – Cancellation, Termination, and Refunds

Users may cancel their subscription via the platform or in writing, provided notice is given at least seven (7) days prior to the next renewal date.

Given the digital nature of the services and their immediate availability, no refunds will be granted once access has been provided.

Soundpitch may terminate or suspend user accounts, without prior notice, in cases of violation of these Terms, misuse of the platform, fraud, or illegal activity.

Article 9 – Intellectual Property

All intellectual property rights to the platform, its content, tools, database, and branding remain the exclusive property of Soundpitch or its licensors.

Users receive a limited, non‑exclusive, revocable license to use the platform during the subscription term, solely for their personal or professional purposes.

Any unauthorized reproduction, distribution, or exploitation of the platform’s content or functionality constitutes a breach of these Terms and may result in legal action.

Article 10 – User Conduct

Users agree to use the platform in compliance with all applicable laws and refrain from:

  • sending unsolicited or unlawful communications to contacts in the database;
  • scraping or harvesting data from the platform;
  • uploading or generating illegal, infringing, or harmful content;
  • attempting to bypass security measures or gain unauthorized access to systems;
  • uploading viruses, malware, or any harmful code;
  • abusing APIs or overloading servers.

Soundpitch reserves the right to investigate suspected breaches and take appropriate action, including account suspension or legal proceedings.

Article 11 – Third-Party Services

The platform may contain links or integrations to third-party websites or services.

Soundpitch is not responsible for the content, availability, or practices of such third-party services.

Article 12 – Service Levels and Support

Soundpitch strives to maintain a high level of service availability but does not guarantee uninterrupted access.

Support inquiries will be addressed as soon as reasonably possible.

Article 13 – Warranties and Liability

Soundpitch provides the platform and its services “as is” and disclaims all warranties, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, and non‑infringement.

Soundpitch does not warrant that the platform will operate uninterrupted, error‑free, or securely.

In no event shall Soundpitch be liable for indirect, incidental, special, or consequential damages, including loss of data, revenue, or goodwill.

Users agree to indemnify and hold harmless Soundpitch from any claims, damages, or costs arising from their use of the platform or breach of these Terms.

Article 14 – Privacy and Data Protection

Soundpitch processes personal data in compliance with applicable privacy laws, including the EU General Data Protection Regulation (GDPR).

Article 15 – Force Majeure

Soundpitch shall not be held liable for any failure or delay in performance caused by events beyond its reasonable control, including but not limited to natural disasters, labor disputes, internet or telecommunications failures, cyber‑attacks, or governmental actions.

Article 16 – Changes to the Terms

Soundpitch reserves the right to amend these Terms at any time.

Users will be notified of significant changes at least seven (7) days in advance.

Continued use of the platform after the effective date of revised Terms constitutes acceptance thereof.

Article 17 – Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with Belgian law.

Any disputes arising out of or relating to these Terms shall fall under the exclusive jurisdiction of the competent courts in Dendermonde, Belgium, unless mandatory law dictates otherwise.

Article 18 – Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Article 19 – Language

These Terms are provided in English for convenience. In case of discrepancy with a translated version, the English version shall prevail.
